The myth of "prevention insurance": Why delegating safety does not exempt you from penalties (and how to protect yourself)

Let's put our cards on the table. As a business owner in the roadside assistance sector, you are dealing with a thousand issues every day: fuel costs, tow-truck maintenance, negotiations with insurers, shift rotas... Faced with an avalanche of regulations, it is completely normal for you to decide to hire an external prevention service (Servicio de Prevención Ajeno, SPA), sign the contract, pay the monthly fee and think: "Done, I don't have to worry about this any more".

We are sorry to break the bad news, but you have just fallen for the most dangerous myth in business management.

Believing that an external service exempts you from criminal or administrative liability in the event of an accident is a mistake that can cost your business, your assets and even your freedom dearly. Let's talk plainly about what the law says and how you can really protect yourself.

The harsh legal reality: The adviser advises, the employer is answerable

In Spain, the Ley de Prevención de Riesgos Laborales (Occupational Risk Prevention Act) is unequivocal. An external prevention service is, as its name suggests, external support, a technical consultancy. They help you assess risks and propose measures, but responsibility for compliance rests solely and exclusively with the employer.

If a serious accident happens on the carriageway tomorrow, the Labour Inspectorate or the judge will not go and ask the prevention service technician for explanations. They will ask you.

The legal key: Responsibility for risk prevention cannot be delegated. Paying an external company does not hand you a shield of immunity; it only gives you tools that you, as the leader, must ensure are followed to the letter.

When can you be 100% sure you are doing it right? The answer is simple: when you stop seeing prevention as a mere office paperwork formality ("the Mutua paperwork") and start understanding it as part of your company's day-to-day strategy.

The danger of "one-size-fits-all" solutions

The roadside assistance sector is not an office or a factory with controlled risks. Our operators work just centimetres from vehicles travelling at 120 km/h, at night, in bad weather and handling heavy loads or dangerous goods.

Most generalist external prevention services do not know the real particularities of our roads. They hand you standard manuals that often do not fit the reality of a job in the middle of a dual carriageway.

To protect yourself, you need to be the person who knows best your obligations, your responsibilities and the specific risks of your activity. If the business owner does not know what to demand, it is impossible for them to check whether their workers, subcontractors or middle managers are acting safely.

How to solve this problem at the root (and at no cost)

Knowing what to do during an inspection, understanding the types of penalties or knowing how to integrate safety into the company's quality management is not something you learn by intuition. It requires sector-specific training.

At REAC (Red de Empresas de Asistencia en Carretera) we know that ignorance of the rules is the business owner's greatest enemy. That is why we have designed the Course for Business Owners and Managers, specialist training focused exclusively on our sector that is 100% free for all our members.

On this course you will learn, in a direct and practical way:

  • Specific legislation and regulations for the roadside assistance sector.

  • Types of penalties and how to avoid them through correct management.

  • The real roles, obligations and responsibilities of each party (employer, workers, prevention services and subcontractors).

  • Full integration: How to combine prevention with your quality and environmental systems so that the business runs like clockwork.

Joining forces in REAC is not only about securing better commercial agreements or reducing operating costs; it is about safeguarding your legal peace of mind. Don't leave your company's future in the hands of a myth. Know your obligations, train your middle managers and lead a safe business.
