Is your External Prevention Service enough? What every roadside assistance business owner should know

Many business owners in the roadside assistance sector sleep soundly in the belief that, simply because they have hired an External Prevention Service (Servicio de Prevención Ajeno, SPA) and pay its monthly fee, they are legally protected against any accident.

However, the regulatory reality in Spain is much more complex and that peace of mind is often a false sense of security.

The myth of the "signed paper"

It is a common mistake to think that responsibility for prevention is transferred when you hire an external company. Nothing could be further from the truth. The SPA is, by definition, an advisory and support body. The legal, administrative and criminal liability for whatever happens during a rescue job or at the base rests entirely with the employer.

In a high-risk sector such as ours, where we operate on public roads, with heavy loads and in adverse weather conditions, "formal compliance" (having the paperwork) is not the same as real compliance.

The complexity of our regulations

Prevention legislation in Spain is not generic; it intersects with specific regulations on road safety, load handling and, more recently, new environmental requirements. Is your company really prepared to respond to an inspection or, worse still, to a serious accident?

To be sure you are doing it right, the question is not whether you have hired an SPA, but: Do you, as a manager, know your real obligations?

Knowledge: Your best defence

At REAC (Red de Empresas de Asistencia en Carretera), we understand that business owners cannot be legal experts, but they must be the people who know best their own responsibilities and those of their workers, subcontractors and prevention services.

That is why, within our portfolio of free services for members, we highlight the Course for Business Owners and Managers, designed specifically for our sector:

  • Basic legislation and regulations: Understanding the current legal framework and the types of penalties.

  • Roadside assistance-specific regulations: Preventing risks in an office is not the same as on a motorway hard shoulder at 3 in the morning.

  • Integrating prevention: How to make safety not a "nuisance" but a natural part of your company's quality and environmental management.

Unity makes us professionals

At REAC we do not just share tow trucks or jobs; we share knowledge and protection. Being part of the Network gives you access to high-level training that turns prevention from an administrative problem into a competitive advantage.

Next time you review your prevention contracts, ask yourself: Am I covered, or am I just paying a fee?

Did you know that REAC offers these courses completely free of charge to its members? Professionalising your middle managers and operational staff is the shortest route to profitability and legal peace of mind.
